Privacy Policy

1. Introduction

Lion’s Choice (“Lion’s Choice,” “Company,” “we,” “our,” or “us”) respects your privacy. This Privacy Policy describes how we collect, use, disclose, and otherwise process personal data when you use websites, mobile applications, online ordering, loyalty and rewards programs, and other services that link to this Privacy Policy (collectively, the “Services”).

This Privacy Policy explains our privacy practices. It does not itself constitute consent to processing for which applicable law requires an affirmative choice. Where we request consent for a particular activity, including certain non-essential cookies or similar technologies, we request it through Cookie Preferences or another applicable privacy-choice interface.

2. Scope

This Privacy Policy applies to personal data collected:

  • through the Services, including www.lionschoice.com;
  • when you create an account, place an order, participate in a loyalty or rewards program, or otherwise interact with the Services;
  • in email, text, chat, and other electronic communications between you and the Services; and
  • when you interact with Lion’s Choice advertising or applications on third-party platforms that link to this Privacy Policy.

This Privacy Policy does not apply to information collected by a third-party website, application, delivery platform, payment processor, or other service that operates under its own privacy policy, even if that service is linked to or accessible through the Services. It also does not apply to information collected offline unless expressly stated. We may provide additional notices for particular features, services, or activities.

3. Children’s and Minors’ Data

The Services are not directed to children under 13, and we do not knowingly collect personal data from children under 13. If we learn that we collected personal data from a child under 13 without legally sufficient authorization, we will take reasonable steps to delete it. If you believe a child has provided personal data to us, contact us using Section 15.

We do not knowingly sell personal data of consumers under 16 or share it for cross-context behavioral advertising.

4. Personal Data We Collect

“Personal data” means information that identifies, relates to, describes, or could reasonably be linked with an individual or household. Depending on how you interact with us, we may collect the following categories.

4.1 Information You Provide

  • Contact and account information: name, email address, telephone number, postal or delivery address, billing address, username, and account credentials.
  • Order and transaction information: items ordered, pickup or delivery information, purchase history, discounts, returns, and related transaction details.
  • Payment information: information necessary to process payment. Payment-card information is submitted to and processed by our payment processors. Lion’s Choice does not intend to retain complete payment-card numbers or security codes except as permitted and necessary for transaction processing.
  • Loyalty and rewards information: enrollment information, points, rewards, and redemption history.
  • Preferences and demographic information: preferences and demographic information that you choose to provide, including through surveys or account profiles.
  • Communications and content: reviews, feedback, survey responses, photographs, support requests, and messages sent through the Services or by email, text, or chat.
  • Employment inquiries: information submitted through an online employment application or recruiting service, where applicable. A separate applicant notice may apply.

You may decline to provide personal data, but doing so may prevent you from using features such as online ordering, delivery, account services, or loyalty participation.

4.2 Information Collected Automatically

When you interact with the Services, we and providers acting for or in connection with us may automatically collect:

  • Device and browser information: IP address, browser and operating-system type, preferred language, device type, device or browser identifiers, and Internet service provider.
  • Usage and interaction information: pages viewed, links selected, referring and exit pages, dates and times, session duration, page interactions, products viewed or searched, and methods used to navigate the Services.
  • Advertising and measurement information: advertisement impressions, clicks, conversions, campaign information, and related measurement data.
  • Online identifiers: cookie identifiers, browser or device identifiers, and mobile advertising identifiers.
  • Inferences and audience information: interests or audience segments generated or provided by advertising platforms based on interactions with the Services or advertisements.
  • Aggregated or deidentified information: campaign, audience, performance, and usage reports that are not reasonably linkable to an individual.

4.3 Location Information

We may infer general location, such as country, state, city, or approximate area, from an IP address or similar information. We may also use coarse or radius-based location information made available through advertising platforms to reach audiences near restaurant locations.

Unless a feature separately requests and discloses it, Lion’s Choice does not intend to collect precise, real-time GPS location through the Services or collect device location while an application is closed.

4.4 Cookies, Pixels, and Similar Technologies

We and providers acting for or in connection with us use cookies, pixels, tags, local storage, software development kits, and similar technologies for purposes such as operating and securing the Services, remembering choices, understanding use, measuring performance, personalizing content, and supporting advertising.

Some technologies are necessary to operate the Services. Cookie Preferences, available through the website footer, allows you to manage available choices regarding non-essential technologies. Our website and consent tools are configured so that technologies categorized as requiring permission are not intended to activate before the applicable choice is recorded. Because technologies and legal requirements change, the categories, providers, and choices displayed in Cookie Preferences are part of this disclosure.

Depending on configuration and your choices, pixels and similar technologies may process page or event information, referring information, device or browser information, IP address, cookie or device identifiers, and consent or privacy-choice signals.

4.5 Providers Using Tracking Technologies

Providers and third-party platforms may use technologies in connection with analytics, advertising, campaign measurement, social media, security, fraud prevention, and related services. These may include:

  • Google, including Google Analytics and advertising services;
  • Meta;
  • TikTok;
  • The Trade Desk;
  • AiDigital, which facilitates certain advertising activities for Lion’s Choice; and
  • other providers identified through Cookie Preferences or an applicable interface.

Their processing may be governed by their own terms and privacy notices as well as applicable agreements, laws, and the choices described in this Privacy Policy.

4.6 Information From Other Sources

We may receive personal data from service providers and business partners, including payment, ordering, delivery, gift-card, loyalty, email, analytics, advertising, security, fraud-prevention, and customer-management providers.

Where permitted and subject to applicable choices, we may provide or make available first-party information, such as hashed contact information or customer-relationship identifiers, to advertising platforms for audience matching, campaign delivery, suppression, attribution, and measurement. AiDigital may facilitate certain activities under applicable agreements.

4.7 Combined Information

We may combine information obtained from different sources. If combined information identifies or can reasonably be linked to an individual, we treat it as personal data as required by applicable law.

5. How We Use Personal Data

We may use personal data to:

  • provide, operate, maintain, and secure the Services;
  • process and fulfill purchases, orders, pickup, delivery, payments, refunds, and returns;
  • administer accounts and loyalty or rewards programs;
  • provide customer service and respond to requests;
  • send transactional and service communications;
  • send marketing communications in accordance with the choices or consent provided through the applicable signup process;
  • advertise and promote Lion’s Choice, including through audience matching, measurement, attribution, suppression, segmentation, and targeted advertising where permitted;
  • understand and improve the Services and develop aggregated or deidentified reports;
  • customize content and remember preferences;
  • verify information and prevent fraud, misuse, and security incidents;
  • enforce our Terms and other agreements;
  • resolve disputes and comply with legal obligations;
  • process employment inquiries; and
  • carry out another disclosed purpose with consent where required.

If you opt into text messages, message frequency may vary and message and data rates may apply. Reply STOP to opt out and HELP for help. We will process other reasonable opt-out requests as required by applicable law. Carriers are not liable for delayed or undelivered messages.

6. How We Disclose Personal Data

We may disclose personal data to the following categories of recipients for the purposes described in this Privacy Policy:

  • Service providers and contractors: providers of hosting, website operations, customer management, payment processing, ordering, delivery, loyalty, gift cards, communications, analytics, advertising support, security, fraud prevention, and related services.
  • Advertising, analytics, and measurement providers: providers supporting campaign delivery, audience matching, suppression, attribution, analytics, and measurement, including Google, Meta, TikTok, The Trade Desk, AiDigital, and other providers identified through Cookie Preferences.
  • Affiliates: subsidiaries and affiliates for purposes consistent with this Privacy Policy.
  • Business transaction recipients: buyers, successors, advisers, and other parties involved in an actual or proposed merger, acquisition, financing, restructuring, bankruptcy, or transfer of assets.
  • Governmental and legal recipients: courts, regulators, law-enforcement agencies, and other parties when reasonably necessary to comply with law, legal process, or governmental requests.
  • Protection and enforcement recipients: parties to whom disclosure is reasonably necessary to protect rights, property, safety, and security; prevent fraud; enforce agreements; or resolve disputes.
  • Recipients you direct or authorize: parties to whom you ask us to disclose information or to whom disclosure is made with your consent.

Depending on the service and purpose, disclosed information may include contact and account data, order and transaction information, payment-processing information, device and browser information, IP address, coarse location, online identifiers, hashed contact or CRM identifiers, website and advertisement interactions, audience segments, inferred interests, and aggregated or deidentified reports.

Payment-card information is provided to financial transaction processors. We do not authorize advertising providers to receive complete payment-card numbers or card security codes through tracking technologies.

AiDigital facilitates certain advertising activities for Lion’s Choice under applicable agreements and data-processing terms. Other advertising platforms may process information under their own platform terms and privacy notices.

7. Sale, Sharing, and Targeted Advertising

We do not sell personal data for money. Some state laws define “sale,” “sharing,” or “targeted advertising” broadly and may treat certain advertising or analytics disclosures as a sale, sharing, or targeted advertising even when no money is exchanged.

To the extent an applicable practice falls within one of those definitions, you may exercise an available opt-out through Cookie Preferences, a legally recognized browser-based signal as described below, or by contacting us under Section 15.

8. Your Rights and Choices

8.1 Marketing and Cookie Choices

  • Email: Use the unsubscribe link in a promotional email or contact us.
  • Text messages: Reply STOP or use another reasonable opt-out method recognized by applicable law.
  • Cookies and similar technologies: Use Cookie Preferences, available through the website footer, to manage available choices. Browser settings may also allow you to block or delete cookies, although doing so may affect functionality.

8.2 State Privacy Rights

Depending on your residence and whether an applicable state law covers Lion’s Choice, you may have rights to:

  • confirm whether we process personal data and obtain access to it;
  • receive certain personal data in a portable format;
  • correct inaccuracies;
  • request deletion, subject to exceptions;
  • opt out of sale, sharing, targeted advertising, or certain profiling;
  • limit or withdraw consent for certain sensitive-data processing;
  • use an authorized agent; and
  • receive nondiscriminatory treatment for exercising applicable rights.

The scope, exceptions, verification requirements, and response periods vary by law. We may request information reasonably necessary to verify your identity or authority.

Submit a request at privacy@lionschoice.com or through an available privacy-choice mechanism. Choices concerning browser-based technologies should ordinarily be made through Cookie Preferences so they can be applied to the relevant browser or device.

8.3 Appeals

If applicable law provides a right to appeal our decision, email privacy@lionschoice.com with the subject “Privacy Rights Appeal.” We will respond as required by applicable law.

8.4 Global Privacy Control

Our website is configured to detect supported Global Privacy Control (“GPC”) signals. When detected, we treat a supported GPC signal as a request to opt out of sale, sharing, or targeted advertising for the browser or device from which the signal is sent, to the extent required by applicable law. Because GPC is generally browser- or device-specific, you may need to enable it separately on each browser or device.

8.5 Do Not Track

Some browsers offer a Do Not Track (“DNT”) setting. Browser and industry implementations are not uniform. Our consent tools are configured to respond to supported DNT signals, but you should use Cookie Preferences to review and manage the choices available for the relevant browser or device.

8.6 Nevada Residents

Nevada residents may submit a verified request to opt out of a qualifying sale of covered information by emailing privacy@lionschoice.com. We do not currently sell covered information for monetary consideration as described by Nevada law.

8.7 Residents of Other States

Residents of states with comprehensive privacy laws may have additional rights if the applicable law covers Lion’s Choice. We use the common request process above and will provide materially different state-specific treatment where required.

9. Supplemental State Disclosures

9.1 Illinois

Lion’s Choice does not intend to collect biometric identifiers or biometric information, as defined by the Illinois Biometric Information Privacy Act, through the consumer-facing website or mobile application. If that practice changes, we will provide an appropriate separate notice and obtain consent where required.

We will provide breach notices involving Illinois residents when required by applicable law.

9.2 Missouri and General Breach Notification

Lion’s Choice will comply with applicable Missouri consumer-protection, privacy, and data-breach requirements. If a security incident triggers notification duties, we will notify affected individuals and governmental authorities as required by applicable law.

9.3 California

This Privacy Policy is intended to provide disclosures required by the California Online Privacy Protection Act. If and to the extent the California Consumer Privacy Act applies to Lion’s Choice, California residents will receive the notices and rights required by that law, including applicable rights to know, access, delete, correct, opt out of sale or sharing, use an authorized agent, and receive nondiscriminatory treatment.

10. Third-Party Websites and Services

The Services may link to third-party delivery, social-media, payment, employment, and other services. Those services operate under their own terms and privacy notices. We are not responsible for their independent privacy practices or content. Review the applicable third-party notices before providing information.

11. Security

We use administrative, physical, and technical safeguards designed to protect personal data against accidental loss and unauthorized access, use, alteration, and disclosure. We use encrypted connections where appropriate for information transmitted through the Services.

No website, application, system, storage method, or transmission is completely secure. We therefore cannot guarantee the security of personal data. Email, text messages, and chats may not be secure, and you should consider what information you send through those channels. You are responsible for protecting account credentials and notifying us of suspected unauthorized access.

12. Retention

We retain personal data for as long as reasonably necessary for the purposes described in this Privacy Policy or as otherwise permitted or required by law. In determining retention periods, we consider the nature and sensitivity of the information, the purpose of processing, operational needs, legal obligations, dispute resolution, security, and fraud prevention.

When information is no longer reasonably necessary, we may delete, destroy, deidentify, or retain it as permitted by law, including in backups, legal holds, fraud and security records, and deidentified datasets.

13. Dispute Resolution

Disputes arising out of or relating to this Privacy Policy or our data practices may be subject to the dispute-resolution provisions in our Terms and Conditions, to the extent an enforceable agreement applies.

14. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will post the revised policy and update the “Last Updated” date. We will provide additional notice when required by law or reasonably appropriate for a material change.
